Terms & Conditions

1. Agreement

By booking photography services with Cabo Creative Marketing, you agree to the following Terms & Conditions. These terms apply to all photography sessions including weddings, proposals, birthday parties, family sessions, and private events in Cabo San Lucas and surrounding areas.

2. Booking & Retainer

  • A non-refundable retainer is required to secure your event date.

  • Your booking is not confirmed until the retainer payment is received.

  • The remaining balance must be paid before or on the event date (as agreed in contract).

Dates are reserved exclusively once payment is received.

3. Payment Terms

  • Payments are accepted via [Bank Transfer / Zelle / PayPal / Cash – adjust as needed].

  • All prices are listed in USD unless otherwise stated.

  • Any additional hours or services requested on the event day must be paid in full.

4. Cancellations & Rescheduling

  • The retainer is non-refundable.

  • If the client cancels, payments made will not be refunded.

  • Rescheduling may be allowed based on availability.

  • In case of extreme weather or emergencies, we will work with the client to reschedule when possible.

5. Coverage & Responsibility

Cabo Creative Marketing will make every reasonable effort to:

  • Arrive on time

  • Capture key moments discussed before the event

  • Deliver professionally edited images

However, we are not responsible for:

  • Missed shots due to lack of cooperation or time constraints

  • Venue restrictions

  • Weather conditions

  • Interruptions beyond our control

6. Image Delivery

  • Edited photos will be delivered within the agreed timeframe (typically 2–4 weeks unless stated otherwise).

  • Photos are delivered digitally via online gallery.

  • RAW (unedited) files are not included.

Delivery times may vary during peak wedding seasons.

7. Artistic Style

By hiring Cabo Creative Marketing, you acknowledge and accept our artistic style, editing style, and creative direction as seen in our portfolio.

Editing requests that differ significantly from our style may not be accommodated.

8. Copyright & Usage

All photographs remain the copyright property of Cabo Creative Marketing.

Clients receive a personal-use license, allowing them to:

  • Download

  • Print

  • Share on social media

Clients may not:

  • Sell images

  • Edit or apply filters

  • Use images for commercial resale without written permission

We reserve the right to use images for:

  • Portfolio

  • Website

  • Social media

  • Marketing purposes

If you prefer your images to remain private, please notify us in writing before the event.

9. Model Release

By booking our services, clients grant permission for their images to be used for promotional and portfolio purposes unless otherwise requested in writing.

10. Liability

In the unlikely event of:

  • Equipment failure

  • Injury

  • Illness

  • Emergency

Liability is limited to the return of all payments made.

We always carry backup equipment to minimize risks.

11. Force Majeure

We are not liable for circumstances beyond our control including:

  • Natural disasters

  • Government restrictions

  • Travel disruptions

  • Venue closures

12. Travel & Location Fees

Additional travel fees may apply for locations outside Cabo San Lucas or San José del Cabo.

Any permit fees required by specific venues or beaches are the responsibility of the client.
